Terms of use

Article 1: Purpose
The purpose of these "general terms and conditions of use" is to provide a legal framework for the provision of SMARTRIUM site services and their use by the "User".

The general terms and conditions of use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Access to the site by the User signifies acceptance of these general conditions of use.

- In the event of non-acceptance of the general conditions of use stipulated in this contract, the User must renounce access to the services offered by the site.

- SMARTRIUM reserves the right to unilaterally modify the content of these general conditions of use at any time.
Article 2: Legal information
The SMATRIUM website is published by SMARTRIUM SARL, a company with share capital of €5,000 whose registered office is located at ZA Les Lebreyres, 43400 Le Chambon sur Lignon.

The publication manager is Mr Lorenzo PELISSIER.

The site is hosted by WEBFLOW, whose head office is located at 398 11th Street, 2nd FloorCA 94103 San Francisco , with the following e-mail address: contact@webflow.com.
Article 3: Definitions
The purpose of this clause is to define the various essential terms of the contract:

- User: this term refers to any person who uses the site or one of the services offered by the site.

- User content: this is the data transmitted by the User within the site.

- Member: the User becomes a member when he is identified on the site.

- User ID and password: this is all the information required to identify a User on the site. The login and password enable the User to access services reserved for members of the site. The password is confidential.
Article 4: Access to services
The site provides the User with free access to all its pages.

The site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User's expense.

Non-member Users do not have access to services reserved for members. To do so, they must identify themselves using their login and password.

The site makes every effort to ensure quality access to its services. As the obligation is one of means, the site does not undertake to achieve this result.

SÉCURIPRO shall not be held liable for any event due to force majeure resulting in network or server malfunction.

Access to the site's services may be interrupted, suspended or modified at any time, without prior notice, for maintenance or any other reason. The User undertakes not to claim any compensation following the interruption, suspension or modification of this contract.

Article 5: Intellectual property
Trademarks, logos, signs, e-mail addresses and any other content on the site are protected by the Intellectual Property Code and more specifically by copyright.

The User requests prior authorization from the site for any reproduction, publication or copy of the various content.

No hypertext link may be created to the SMARTRIUM site without SMARTRIUM's express prior consent.

If a User or legal entity wishes to create a hypertext link from its site to the SMARTRIUM site, regardless of the medium, it must first contact SMARTRIUM by sending an e-mail to the following address contact@smartrium.eu.

Any silence on the part of SMARTRIUM shall be interpreted as a refusal.

The User agrees to use the site content in a strictly private context. Use of the content for commercial purposes is strictly prohibited.

Any content posted by the User is the sole responsibility of the User. The User undertakes not to put any content online that could harm the interests of third parties. Any legal action taken by an injured third party against the site will be borne by the User.

The User's content may be removed or modified by the site at any time and for any reason. The User does not receive any justification or notification prior to the deletion or modification of User content.
Article 6: Personal data
The information requested when registering on the site is necessary and obligatory for the creation of the User's account. In particular, the e-mail address may be used by the site for the administration, management and animation of the service.

The site ensures that the User's personal information is collected and processed with respect for privacy in accordance with the French Data Protection Act no. 78-17 of January 6, 1978.

Pursuant to Articles 39 and 40 of the Act dated January 6, 1978, the User has the right to access, rectify, delete and object to his or her personal data. The User may exercise this right via:

Article 7: Liability and force majeure
The sources of the information published on the site are deemed reliable. However, the site reserves the right not to guarantee the reliability of the sources. The information provided on the site is for information purposes only. Thus, the User alone assumes full responsibility for the use of the information and content of this site.

The User is responsible for keeping his or her password secret. Any disclosure of the password, in any form whatsoever, is prohibited.

The User assumes all risks associated with the use of his/her login and password. The site declines all responsibility.

Any use of the service by the User resulting directly or indirectly in damage must be compensated by the site.

The site cannot guarantee optimal security and confidentiality of transmitted data. However, the site undertakes to use all necessary means to guarantee data security and confidentiality to the best of its ability.

The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
Article 8: Hypertext links
Numerous outgoing hypertext links are present on the site, however the web pages to which these links lead in no way engage the responsibility of SMARTRIUM, which has no control over these links.

The User therefore refrains from engaging the responsibility of the site concerning the content and resources relating to these outgoing hypertext links.
Article 9: Contract evolution
The site reserves the right to modify the clauses stipulated in the present contract at any time.
Article 10: Duration
The duration of the present contract is indefinite. The contract takes effect with regard to the User from the time of use of the service.
Article 11: Applicable law and jurisdiction
This contract is governed by French law. In the event of failure to reach an amicable settlement of a dispute between the parties, only the courts within the jurisdiction of the RIOM Court of Appeal shall have jurisdiction.
